近年來,電子商務作為一種新型商業活動發展迅速,給商業生態和人們生產生活都帶來重要影響。電子商務的發展壯大既給經濟發展帶來新動力,也給市場秩序維護、消費者和經營者權益保護等帶來一系列新問題。解決這些問題,需要用法治手段來引導和保障電子商務持續健康發展。
今年(nian)1月1日(ri)起(qi),我國(guo)電(dian)(dian)(dian)(dian)(dian)子(zi)(zi)商(shang)(shang)務(wu)(wu)法(fa)(fa)正式施行。電(dian)(dian)(dian)(dian)(dian)子(zi)(zi)商(shang)(shang)務(wu)(wu)法(fa)(fa)是(shi)(shi)(shi)調整我國(guo)境內通(tong)過(guo)互聯網(wang)等信息網(wang)絡(luo)銷售商(shang)(shang)品或提供(gong)服務(wu)(wu)等經營活動(dong)(dong)的(de)(de)(de)(de)專門法(fa)(fa),它的(de)(de)(de)(de)出(chu)臺(tai)(tai)和施行標(biao)志著(zhu)我國(guo)正逐步健全與互聯網(wang)經濟相適應(ying)的(de)(de)(de)(de)法(fa)(fa)律。電(dian)(dian)(dian)(dian)(dian)子(zi)(zi)商(shang)(shang)務(wu)(wu)法(fa)(fa)確立(li)了(le)電(dian)(dian)(dian)(dian)(dian)子(zi)(zi)商(shang)(shang)務(wu)(wu)活動(dong)(dong)的(de)(de)(de)(de)一(yi)系列基(ji)本規(gui)(gui)則(ze),對(dui)規(gui)(gui)范(fan)電(dian)(dian)(dian)(dian)(dian)商(shang)(shang)運營、保(bao)護消(xiao)費(fei)者(zhe)(zhe)和經營者(zhe)(zhe)合(he)(he)法(fa)(fa)權(quan)(quan)(quan)益具(ju)有重要意義。這(zhe)(zhe)些(xie)規(gui)(gui)則(ze)主要體(ti)現(xian)(xian)在(zai)以下幾方面:一(yi)是(shi)(shi)(shi)保(bao)障權(quan)(quan)(quan)益規(gui)(gui)則(ze)。保(bao)障權(quan)(quan)(quan)益的(de)(de)(de)(de)主體(ti)范(fan)圍包(bao)括電(dian)(dian)(dian)(dian)(dian)子(zi)(zi)商(shang)(shang)務(wu)(wu)經營者(zhe)(zhe)、消(xiao)費(fei)者(zhe)(zhe)、知(zhi)識(shi)產(chan)權(quan)(quan)(quan)人(ren)(ren)等。電(dian)(dian)(dian)(dian)(dian)子(zi)(zi)商(shang)(shang)務(wu)(wu)法(fa)(fa)對(dui)消(xiao)費(fei)者(zhe)(zhe)可能(neng)受到侵(qin)害的(de)(de)(de)(de)主要權(quan)(quan)(quan)益作了(le)相應(ying)規(gui)(gui)定,同時(shi)也強化了(le)對(dui)平(ping)臺(tai)(tai)內經營者(zhe)(zhe)和知(zhi)識(shi)產(chan)權(quan)(quan)(quan)人(ren)(ren)合(he)(he)法(fa)(fa)權(quan)(quan)(quan)益的(de)(de)(de)(de)保(bao)護。二是(shi)(shi)(shi)規(gui)(gui)范(fan)秩序(xu)(xu)規(gui)(gui)則(ze)。電(dian)(dian)(dian)(dian)(dian)子(zi)(zi)商(shang)(shang)務(wu)(wu)法(fa)(fa)規(gui)(gui)定,國(guo)家建立(li)符合(he)(he)電(dian)(dian)(dian)(dian)(dian)子(zi)(zi)商(shang)(shang)務(wu)(wu)特點的(de)(de)(de)(de)協同管(guan)理體(ti)系,推動(dong)(dong)形成有關部門、電(dian)(dian)(dian)(dian)(dian)子(zi)(zi)商(shang)(shang)務(wu)(wu)行業組織、電(dian)(dian)(dian)(dian)(dian)子(zi)(zi)商(shang)(shang)務(wu)(wu)經營者(zhe)(zhe)、消(xiao)費(fei)者(zhe)(zhe)等共同參與的(de)(de)(de)(de)電(dian)(dian)(dian)(dian)(dian)子(zi)(zi)商(shang)(shang)務(wu)(wu)市場治理體(ti)系。這(zhe)(zhe)體(ti)現(xian)(xian)了(le)規(gui)(gui)范(fan)電(dian)(dian)(dian)(dian)(dian)子(zi)(zi)商(shang)(shang)務(wu)(wu)行為、維(wei)護市場秩序(xu)(xu)的(de)(de)(de)(de)立(li)法(fa)(fa)目的(de)(de)(de)(de)。三是(shi)(shi)(shi)促進發(fa)展(zhan)(zhan)規(gui)(gui)則(ze)。促進發(fa)展(zhan)(zhan)體(ti)現(xian)(xian)為電(dian)(dian)(dian)(dian)(dian)子(zi)(zi)商(shang)(shang)務(wu)(wu)法(fa)(fa)在(zai)產(chan)業政策、綠色發(fa)展(zhan)(zhan)、基(ji)礎(chu)設(she)(she)施等方面的(de)(de)(de)(de)規(gui)(gui)定,還包(bao)括加(jia)強電(dian)(dian)(dian)(dian)(dian)子(zi)(zi)商(shang)(shang)務(wu)(wu)標(biao)準體(ti)系建設(she)(she)、電(dian)(dian)(dian)(dian)(dian)子(zi)(zi)商(shang)(shang)務(wu)(wu)與各產(chan)業融(rong)合(he)(he)發(fa)展(zhan)(zhan)、跨(kua)境電(dian)(dian)(dian)(dian)(dian)子(zi)(zi)商(shang)(shang)務(wu)(wu)發(fa)展(zhan)(zhan)等方面的(de)(de)(de)(de)規(gui)(gui)定。這(zhe)(zhe)些(xie)規(gui)(gui)定為促進電(dian)(dian)(dian)(dian)(dian)子(zi)(zi)商(shang)(shang)務(wu)(wu)發(fa)展(zhan)(zhan)提供(gong)了(le)法(fa)(fa)律依據。
積(ji)極保(bao)護(hu)消費(fei)者(zhe)(zhe)(zhe)合法(fa)(fa)(fa)權(quan)(quan)益(yi)是電(dian)子(zi)商(shang)(shang)務(wu)法(fa)(fa)(fa)的(de)立法(fa)(fa)(fa)目的(de)之一(yi)。電(dian)子(zi)商(shang)(shang)務(wu)法(fa)(fa)(fa)制定了一(yi)系列規則,防止電(dian)子(zi)商(shang)(shang)務(wu)平(ping)(ping)臺(tai)(tai)經(jing)營者(zhe)(zhe)(zhe)和(he)平(ping)(ping)臺(tai)(tai)內經(jing)營者(zhe)(zhe)(zhe)利用(yong)(yong)影響(xiang)力(li)侵害消費(fei)者(zhe)(zhe)(zhe)的(de)合法(fa)(fa)(fa)權(quan)(quan)益(yi)。電(dian)子(zi)商(shang)(shang)務(wu)法(fa)(fa)(fa)明(ming)確(que)要(yao)求電(dian)子(zi)商(shang)(shang)務(wu)平(ping)(ping)臺(tai)(tai)經(jing)營者(zhe)(zhe)(zhe)應當(dang)遵循公(gong)(gong)開(kai)、公(gong)(gong)平(ping)(ping)、公(gong)(gong)正(zheng)的(de)原則,制定平(ping)(ping)臺(tai)(tai)服(fu)務(wu)協議(yi)和(he)交(jiao)易規則,明(ming)確(que)進入和(he)退出平(ping)(ping)臺(tai)(tai)、商(shang)(shang)品和(he)服(fu)務(wu)質量保(bao)障(zhang)、消費(fei)者(zhe)(zhe)(zhe)權(quan)(quan)益(yi)保(bao)護(hu)、個人(ren)信(xin)(xin)(xin)息(xi)保(bao)護(hu)等方(fang)面(mian)的(de)權(quan)(quan)利和(he)義務(wu)。電(dian)子(zi)商(shang)(shang)務(wu)平(ping)(ping)臺(tai)(tai)經(jing)營者(zhe)(zhe)(zhe)還要(yao)建立健全信(xin)(xin)(xin)用(yong)(yong)評(ping)(ping)價(jia)制度,公(gong)(gong)示信(xin)(xin)(xin)用(yong)(yong)評(ping)(ping)價(jia)規則,為消費(fei)者(zhe)(zhe)(zhe)提(ti)供對(dui)平(ping)(ping)臺(tai)(tai)內銷售的(de)商(shang)(shang)品或(huo)者(zhe)(zhe)(zhe)提(ti)供的(de)服(fu)務(wu)進行(xing)評(ping)(ping)價(jia)的(de)途徑(jing)。過去,我國法(fa)(fa)(fa)律對(dui)網站(zhan)競價(jia)排名行(xing)為一(yi)直(zhi)沒有(you)明(ming)確(que)界定。電(dian)子(zi)商(shang)(shang)務(wu)法(fa)(fa)(fa)第(di)四十條明(ming)確(que)要(yao)求,對(dui)于競價(jia)排名的(de)商(shang)(shang)品或(huo)者(zhe)(zhe)(zhe)服(fu)務(wu),應當(dang)顯著標明(ming)“廣告(gao)”。這是在立法(fa)(fa)(fa)層(ceng)面(mian)的(de)一(yi)個重要(yao)突破,對(dui)于規范互聯網搜索服(fu)務(wu)具有(you)重大意(yi)義。電(dian)子(zi)商(shang)(shang)務(wu)法(fa)(fa)(fa)要(yao)求經(jing)營者(zhe)(zhe)(zhe)全面(mian)、真實、準確(que)、及(ji)時地披露商(shang)(shang)品或(huo)者(zhe)(zhe)(zhe)服(fu)務(wu)信(xin)(xin)(xin)息(xi),不得以虛構(gou)交(jiao)易、編造用(yong)(yong)戶評(ping)(ping)價(jia)等方(fang)式(shi)欺(qi)騙(pian)、誤導消費(fei)者(zhe)(zhe)(zhe),要(yao)尊重和(he)平(ping)(ping)等保(bao)護(hu)消費(fei)者(zhe)(zhe)(zhe)合法(fa)(fa)(fa)權(quan)(quan)益(yi)。
電子(zi)(zi)(zi)(zi)(zi)商(shang)(shang)(shang)(shang)務(wu)(wu)(wu)(wu)平(ping)臺(tai)(tai)(tai)(tai)聯(lian)結起(qi)平(ping)臺(tai)(tai)(tai)(tai)內經(jing)(jing)營(ying)(ying)者、消(xiao)費者、物流經(jing)(jing)營(ying)(ying)者等各主體(ti),它們的(de)(de)規范(fan)運營(ying)(ying)對(dui)電子(zi)(zi)(zi)(zi)(zi)商(shang)(shang)(shang)(shang)務(wu)(wu)(wu)(wu)活動具有(you)重大影(ying)響。為(wei)有(you)效規范(fan)電子(zi)(zi)(zi)(zi)(zi)商(shang)(shang)(shang)(shang)務(wu)(wu)(wu)(wu)平(ping)臺(tai)(tai)(tai)(tai)運營(ying)(ying),電子(zi)(zi)(zi)(zi)(zi)商(shang)(shang)(shang)(shang)務(wu)(wu)(wu)(wu)法以(yi)大量(liang)條(tiao)文對(dui)電子(zi)(zi)(zi)(zi)(zi)商(shang)(shang)(shang)(shang)務(wu)(wu)(wu)(wu)平(ping)臺(tai)(tai)(tai)(tai)經(jing)(jing)營(ying)(ying)者的(de)(de)權利(li)、義務(wu)(wu)(wu)(wu)、責任等作(zuo)出(chu)規定。比(bi)如(ru),第(di)二十(shi)八條(tiao)要求電子(zi)(zi)(zi)(zi)(zi)商(shang)(shang)(shang)(shang)務(wu)(wu)(wu)(wu)平(ping)臺(tai)(tai)(tai)(tai)經(jing)(jing)營(ying)(ying)者應當(dang)按(an)照規定向市場監督管理部(bu)門報送(song)平(ping)臺(tai)(tai)(tai)(tai)內經(jing)(jing)營(ying)(ying)者的(de)(de)身(shen)份信(xin)息(xi)(xi),并(bing)向稅務(wu)(wu)(wu)(wu)部(bu)門報送(song)平(ping)臺(tai)(tai)(tai)(tai)內經(jing)(jing)營(ying)(ying)者的(de)(de)身(shen)份信(xin)息(xi)(xi)和(he)與納稅有(you)關的(de)(de)信(xin)息(xi)(xi),這為(wei)平(ping)臺(tai)(tai)(tai)(tai)經(jing)(jing)營(ying)(ying)者設(she)定了履行監督和(he)管理職責的(de)(de)法律(lv)義務(wu)(wu)(wu)(wu)。又如(ru),第(di)三十(shi)一條(tiao)要求電子(zi)(zi)(zi)(zi)(zi)商(shang)(shang)(shang)(shang)務(wu)(wu)(wu)(wu)平(ping)臺(tai)(tai)(tai)(tai)經(jing)(jing)營(ying)(ying)者應當(dang)記(ji)錄、保(bao)存平(ping)臺(tai)(tai)(tai)(tai)上發(fa)布的(de)(de)商(shang)(shang)(shang)(shang)品(pin)和(he)服務(wu)(wu)(wu)(wu)信(xin)息(xi)(xi)、交易(yi)信(xin)息(xi)(xi),并(bing)確保(bao)信(xin)息(xi)(xi)的(de)(de)完整性(xing)、保(bao)密性(xing)、可用性(xing)。這樣(yang)一來,如(ru)果(guo)發(fa)生(sheng)了涉嫌侵害消(xiao)費者權益(yi)的(de)(de)行為(wei),平(ping)臺(tai)(tai)(tai)(tai)保(bao)存的(de)(de)交易(yi)數(shu)據信(xin)息(xi)(xi)有(you)助(zhu)于還原真相,保(bao)障電子(zi)(zi)(zi)(zi)(zi)商(shang)(shang)(shang)(shang)務(wu)(wu)(wu)(wu)交易(yi)安全(quan)。
電(dian)(dian)(dian)子商務法(fa)(fa)通過大量明確、具體的(de)(de)法(fa)(fa)律規范,實(shi)事求是地(di)回應了電(dian)(dian)(dian)子商務發(fa)展中需要(yao)解決的(de)(de)現(xian)實(shi)問(wen)題(ti),為我國電(dian)(dian)(dian)子商務發(fa)展提(ti)供了有力(li)法(fa)(fa)治保(bao)障。但也要(yao)看到,電(dian)(dian)(dian)子商務法(fa)(fa)的(de)(de)出(chu)(chu)臺僅(jin)僅(jin)是我國電(dian)(dian)(dian)子商務立法(fa)(fa)工(gong)作的(de)(de)第一(yi)步。電(dian)(dian)(dian)子商務隨著技術的(de)(de)發(fa)展、商業(ye)模(mo)式的(de)(de)創(chuang)新(xin),還會不(bu)(bu)斷(duan)出(chu)(chu)現(xian)新(xin)情況(kuang)新(xin)問(wen)題(ti)。這就要(yao)求我們(men)不(bu)(bu)斷(duan)根據新(xin)情況(kuang)新(xin)問(wen)題(ti)完善電(dian)(dian)(dian)子商務相關法(fa)(fa)律法(fa)(fa)規,為電(dian)(dian)(dian)子商務持續健(jian)康發(fa)展營(ying)造更好的(de)(de)法(fa)(fa)治環境、提(ti)供更有力(li)的(de)(de)法(fa)(fa)治保(bao)障。
